A space for everyone

Tesa is a community of creators and fans. These guidelines keep the platform safe, authentic and lawful. They are written to comply with Kenyan law, including the Computer Misuse and Cybercrimes Act, 2018, the Films and Stage Plays Act (Cap 222), the Copyright Act, 2001, the Children Act, 2022, the Sexual Offences Act, 2006 and the National Cohesion and Integration Act, 2008. By posting on Tesa you agree to follow them and to comply with the law. They form part of our Terms of Service.

Adults only

You must be 18 years or older to create an account, post or purchase content on Tesa. Every person who appears in content you upload must also have been an adult when it was made and have given clear consent to appear and to the content being published and sold on Tesa.

Creators: age and consent records

  • Before you publish, get written consent from every person who appears, covering the recording, publishing on Tesa and selling access, and keep a copy of their government-issued photo ID showing they are 18 or over.
  • Keep these records for at least seven years after the content is last available on Tesa and send them to us within seven days if we ask.
  • If anyone withdraws consent, remove the content and tell us.
  • We may verify your own age and identity before you can publish or withdraw earnings. Where age or consent cannot be shown, we remove the content and may close the account and withhold related earnings.

What we encourage

  • Original content you created or have the rights to share.
  • Respectful conversation, even when you disagree.
  • Clear, honest descriptions and pricing of paid and exclusive content.

Zero tolerance: children

Any content that sexualises, exploits or endangers a person under 18 is strictly prohibited. So is content that appears to show a minor, even if everyone in it is an adult, including school uniforms or settings, child-like role play, and drawn, animated or AI-generated material. This is a serious criminal offence under the Children Act, 2022, the Sexual Offences Act, 2006 and section 24 of the Computer Misuse and Cybercrimes Act, 2018. We remove such content immediately, permanently ban the account, and report it to the Directorate of Criminal Investigations and relevant child protection authorities. There are no second chances.

What is not allowed

  • Non-consensual content: sharing intimate images or videos of any person without their consent is an offence under section 37 of the Computer Misuse and Cybercrimes Act. This includes "revenge" content, hidden-camera or secretly recorded material, and content of anyone asleep, unconscious, drunk, drugged or otherwise unable to consent.
  • Sexual violence and abuse: rape, sexual assault, coercion or non-consent, whether real or simulated, incest, bestiality, and content that sexualises serious violence, torture, bodily harm or death.
  • Deepfakes and fake intimate imagery: sexual or nude images or video of a real person created or altered with AI, editing or face swapping.
  • Sex work and trafficking: offering, arranging or advertising sexual services, escort work or paid meetings, and anything connected to human trafficking or exploitation (Counter-Trafficking in Persons Act, 2010).
  • Off-platform payments: asking fans to pay outside Tesa for content published here.
  • Leaks and redistribution: reposting, recording or selling other creators' content, including content bought on Tesa.
  • Harassment and threats: cyber harassment, stalking, bullying and threats of harm (sections 27 and 32 of the Computer Misuse and Cybercrimes Act).
  • Hate speech and incitement: content that stirs up ethnic hatred or discrimination (section 13 of the National Cohesion and Integration Act) or incites violence.
  • Fraud, scams and impersonation: phishing, pyramid schemes, fake giveaways, impersonating another person or Tesa staff (sections 29 and 30 of the Computer Misuse and Cybercrimes Act; Consumer Protection Act, 2012).
  • False or misleading publications intended to deceive (sections 22 and 23 of the Computer Misuse and Cybercrimes Act).
  • Intellectual property infringement: content you did not create and have no licence to distribute (Copyright Act, 2001).
  • Content restricted by film classification law: content that has been refused classification or that violates conditions imposed under the Films and Stage Plays Act and Kenya Film Classification Board guidelines.
  • Illegal goods and activity: promotion or sale of drugs, weapons, wildlife trophies, unlicensed betting, or any other activity that violates Kenyan law, including the Prevention of Terrorism Act, 2012.
  • Privacy violations: publishing another person's personal data (doxxing) contrary to the Data Protection Act, 2019.

Deleting your videos or account

  • You can remove a video at any time. Removed videos go to your trash, where you can restore them.
  • You can delete your whole account from your account settings. Your profile and videos disappear straight away, and after 7 days (unless you log back in to cancel) your videos are permanently deleted from Tesa and from our video hosting provider, along with your other content and personal data.
  • Withdraw your earnings first: you can't delete your account while you have a balance above the minimum withdrawal or a withdrawal in progress, and a balance below the minimum is forfeited.
  • Fans who bought your videos lose access once they are deleted.
  • Keep the age and consent records of everyone in your videos for seven years even after deleting them or your account; we may still ask for them.
  • Content under an open report is kept until we have reviewed it, and anything needed by the authorities is preserved, even if you delete your account.

Copyright and takedowns

If you believe content on Tesa infringes your copyright, you may send us a takedown notice under section 35B of the Copyright Act, 2001 (as amended in 2019) to support@tesa-app.com. Your notice should identify the work, the infringing content, your rights in it, and be signed. We act on valid notices within the statutory timelines, notify the uploader, and terminate the accounts of repeat infringers. Knowingly sending a false takedown notice is itself an offence under the Act.

Enforcement

When content breaks these rules we may remove it, limit its reach, suspend or withhold payouts connected to it, or take action on the account involved, up to and including a permanent ban for serious or repeated violations. Earnings from content involving minors, made without consent or otherwise unlawful are forfeited. Banned users may not open new accounts. We preserve evidence and cooperate with the Office of the Data Protection Commissioner, the Kenya Film Classification Board, the Directorate of Criminal Investigations and other lawful authorities. If you believe we made a mistake, write to support@tesa-app.com or open a ticket on the support page and a person will review the decision.

Reporting

If you see something that breaks these guidelines, or a profile using someone else's photos, use the report button on the video or profile, or email support@tesa-app.com. If content shows you without your consent, tell us and we will prioritise it. Every report is reviewed, and we never tell the reported user who reported them. Reports involving an immediate risk to someone's safety should also go to the police: dial 999 or 911, or report online abuse to the DCI.
